The EEOC is suing Amerisource-Bergen Corp., claiming the pharmaceutical distributor violated the Age Discrimination in Employment Act when it failed to hire a 60-year-old man for a telecom manager position.
Ameriscource, based near Valley Forge, allegedly told the man he was overqualified for the job after he submitted a r?sum? detailing 40 years of experience in the field. Ultimately, Amerisource hired someone 20 years younger to fill the position.
The unsuccessful applicant filed an age discrimination complaint with the EEOC, which investigated and unsuccessfully tried to mediate the dispute.
That?s when the commission decided to sue on the man?s behalf, contending that his age was the only reason he wasn?t hired.
Note: Never say someone is ?overqualified? for a job. Since it is impossible to be too qualified, applicants have no trouble spotting age discrimination behind such language.
